The agreement between you and Fusion OS Innovations Inc.
By using fusionos.ca, signing up for any plan, submitting a form, or applying to the affiliate program, you agree to these Terms. If you do not agree, do not use the service.
Fusion OS provides automated lead capture, SMS-to-CRM, website hosting, and related digital services. Each plan's specific scope is described on the pricing page or in the Statement of Work signed at onboarding. We reserve the right to modify, improve, or discontinue features with reasonable notice.
You agree not to use the service to:
Violation may result in immediate suspension or termination without refund.
You retain ownership of all content you upload and all leads captured through your service (the "Customer Content"). You grant Fusion OS a limited licence to host, process, and display the Customer Content solely to operate the service for you. We will not use Customer Content to train external models or share it with competitors.
We aim for 99.5% monthly uptime. The service is provided "as is" without warranties of any kind. Scheduled maintenance windows will be announced in advance when possible. We are not liable for downtime caused by upstream vendors (Stripe, Twilio, Supabase, Vercel, etc.) or force majeure events.
Many customer-facing interactions are handled by our AGI agent, Nova. By using the service you acknowledge that automated systems may handle replies, calls, and decisions within scope. When directly asked, our systems disclose AI authorship honestly. You retain the right to escalate to a human at any time by emailing nova@fusionos.ca.
Affiliates ("Nova Sales Army" members) operate as independent contractors, not employees. Commissions are paid on confirmed, non-refunded sales for the full duration of each contract sold. Total payout to all affiliates in any sale is capped at 25% of the sale amount. Specific affiliate terms — including the Corvette milestone, level requirements, and payout schedule — are detailed in the affiliate agreement signed at approval. Fusion OS may modify the affiliate program with 60 days' notice; existing accrued commissions are honoured.
The Fusion OS platform, the Nova brand, the phoenix mark, the website code, and all related materials are owned by Fusion OS Innovations Inc. or its licensors. You may not copy, modify, redistribute, or create derivative works without written permission. Customer-specific deliverables (your built website) are licensed to you for your business use; the underlying templates and infrastructure remain ours.
To the maximum extent permitted by law, Fusion OS's total liability arising from or related to the service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, incidental, or punitive damages including lost profits, lost data, or business interruption — even if we were advised of the possibility.
You agree to indemnify Fusion OS against claims, damages, or losses arising from your use of the service in violation of these Terms or applicable law, including but not limited to claims that your use of the service infringed a third party's rights.
Either party may terminate the agreement at any time. Termination by you ends billing at the end of the current period. Termination by us for material breach (non-payment, abuse, illegal use) is immediate. On termination, you have 30 days to export your data; after that we may delete it.
We try to resolve disputes amicably first. If we cannot, disputes are governed by the laws of Ontario, Canada and submitted to the courts of Ottawa, Ontario. Both parties waive the right to participate in any class action.
We may update these Terms. Material changes are announced via email or on this page with 30 days' notice. Continued use after the effective date constitutes acceptance.
